Credit Application

The following authorization(s) apply to this application and apply subsequently for purposes of updating, renewing or extending credit and for reviewing or collecting any resulting credit extension.

1. A photo-static or facsimile copy of this authorization will be valid as the original.
2. The federal Equal Credit Opportunity Act prohibits creditors from discriminating against applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant’s income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law concerning this creditor is the Consumer Financial Protection Bureau, 1700 G Street NW, Washington D.C. 20006. If this Application is denied, the Applicant have the right to a written statement of the specific reasons for the denial.
3. By signing this Application, you hereby expressly affirm that, by completing this Application in any capacity, including, without limitation, as the principal of a formal business entity, a sole proprietor or a guarantor, even if your personal creditworthiness alone is the basis for establishing eligibility for services sought by this Application, you are seeking financing to purchase equipment for commercial and/or business purposes only, and not for personal, family or household use.
4. AUTHORIZATION TO CONTACT BY PHONE. BY SIGNING THIS APPLICATION, CANYON RIDGE LEASING CO, INC., ITS AFFILIATES, AGENTS AND INDEPENDENT CONTRACTORS ARE AUTHORIZED TO CONTACT THE APPLICANT USING ANY TELEPHONE NUMBER PROVIDED TO CANYON RIDGE LEASING CO, INC. OR FROM WHICH A CALL IS PLACED TO CANYON RIDGE LEASING CO, INC., OR ANY TELEPHONE NUMBER WHERE CANYON RIDGE LEASING CO, INC. BELIEVES IT MAY REACH THE APPLICANT, USING ANY MEANS OF COMMUNICATION, INCLUDING, BUT NOT LIMITED TO, CALLS OR TEXT MESSAGES TO MOBILE, CELLULAR, WIRELESS OR SIMILAR DEVICES AND CALLS OR TEXT MESSAGES USING AN AUTOMATED TELEPHONE DIALING SYSTEM AND/OR ARTIFICIAL VOICES OR PRERECORDED MESSAGES, EVEN IF CHARGES ARE INCURRED FOR RECEIVING SUCH COMMUNICATIONS.
5. AUTHORIZATION TO CONTACT BY OTHER MEANS. THE APPLICANT ALSO AGREES THAT CANYON RIDGE LEASING CO, INC., ITS AFFILIATES, AGENTS AND INDEPENDENT CONTRACTORS MAY USE ANY OTHER MEDIUM, AS PERMITTED BY LAW AND INCLUDING, BUT NOT LIMITED TO, MAIL, E-MAIL AND FACSIMILE, TO CONTACT THE APPLICANT.
6. RIGHTS TO OPT-OUT OR MAKE CHANGES. IT IS UNDERSTOOD THAT AGREEMENT TO SECTIONS 4. OR 5. ABOVE IS NOT A CONDITION TO OBTAINING FINANCING. If opting out of section 4. and/or 5. is desired, or if the Applicant wants to change how Canyon Ridge Leasing Co, Inc. contacts the Applicant, including with respect to any telephone number that Canyon Ridge Leasing Co, Inc. might use, the Applicant may call Canyon Ridge Leasing Co, Inc. at +1 (806) 200-6034 or write to Canyon Ridge Leasing Co, Inc. at 1901 W. Amarillo Blvd, Amarillo, Texas 79107.

Signing this Application authorizes the release of credit information to Canyon Ridge Leasing Co, Inc. or its designee from any source including credit reporting agencies and the personal, bank, and credit references listed above: (i) to evaluate this Application; and (ii) if this Application is approved, for purposes of updating, renewing, extending, reviewing, servicing, and collecting on the account, as well as other legitimate purposes associated with the account. Canyon Ridge Leasing Co, Inc. will, upon request, advise whether a credit report was requested and, if it was, Canyon Ridge Leasing Co, Inc. will provide the name and address of the credit reporting agency that furnished the report.

Applicant understands and agrees that: (i) Canyon Ridge Leasing Co, Inc. may report information to credit reporting agencies about the Applicant; (ii) late payments, missed payments, or other defaults may be reflected in the Applicant’s credit report(s); (iii) Canyon Ridge Leasing Co, Inc. may provide the information that I provide in this Application to its affiliates and its non-affiliated third-party business partners to use for the purpose of determining my eligibility for products or services requested by completing this Application and/or for their everyday business purposes in providing services that result from this Application; and (iv) Canyon Ridge Leasing Co, Inc. affiliates may also use this information when they are considering whether to offer financial or other products or services to the Applicant, unless the Applicant instructs Canyon Ridge Leasing Co, Inc. not to share such information for this purpose. To dispute any information on a credit report that is reported by Canyon Ridge Leasing Co, Inc., send a written notice of dispute to Canyon Ridge Leasing Co, Inc. at 1901 W. Amarillo Blvd, Amarillo, Texas 79107. Disputes sent to any other address or that are not received from a credit reporting agency will not be investigated. A dispute must include the applicable account number, the specific information disputed, the basis for the dispute and all supporting documentation or other information to be considered.

Canyon Ridge Leasing Co, Inc. non-affiliated third-party business partners, including those it uses to provide services to you resulting from this Application, may also use information obtained from this Application to market products or services to the Applicant, unless the Applicant instructs Canyon Ridge Leasing Co, Inc. not to share such information for this purpose in writing and delivered to Canyon Ridge Leasing Co, Inc., at 1901 W. Amarillo Blvd, Amarillo, Texas 79107. Canyon Ridge Leasing Co, Inc. hereafter will provide the Applicant with its privacy notice regarding the Applicant’s ability to permit or restrict Canyon Ridge Leasing Co, Inc. sharing of the Applicant’s information with its affiliates as may be required by applicable law. In the event the Applicant does not become, or ceases to be, an Canyon Ridge Leasing Co, Inc. customer, Canyon Ridge Leasing Co, Inc. may still provide the information obtained from this Application in the manner, and subject to the limitations, set forth above. However, the Applicant may contact Canyon Ridge Leasing Co, Inc. at any time to limit such sharing pursuant to applicable law. Applicant agrees that Canyon Ridge Leasing Co, Inc. may release any information if it believes it is required to comply with any governmental or legal process, whether or not such release is actually required, or when it is necessary or desirable in connection with a transaction or investigating a potential loss.

Applicant agrees that this agreement shall be construed and interpreted pursuant to the laws of the State of Texas and Potter County, Texas.

This Application is executed and delivered as an incident to a transaction negotiated and consummated in Potter County, Texas, and shall be governed by and construed in accordance with the laws of the State of Texas. Applicant, for itself and its successors and assigns, hereby irrevocably (a) submits to the nonexclusive jurisdiction of the state and federal courts in Texas, (b) waives, to the fullest extent permitted by law, any objection that it may now or in the future have to the laying of venue of any litigation arising out of or in connection with any document arising by reason of this Application in the a court of competent jurisdiction in Potter County, Texas, or in the United States District Court for the Northern District of Texas, Amarillo Division, (c) waives any objection it may now or hereafter have as to the venue of any such action or proceeding brought in such court or that such court is an inconvenient forum and (d) agrees that any legal proceeding against any party to any Loan Document arising out of or in connection with this Application, and any document arising by reason of this Application, may be brought in one of the foregoing courts.

This Application may be provided to Canyon Ridge Leasing Co, Inc., its designee, or any third parties for purpose of attempting to establish credit on behalf of Applicant. This Application shall remain Canyon Ridge Leasing Co, Inc. property. Applicant warrants and represents that all of the information contained in this Application is true, correct and complete, and acknowledges that Canyon Ridge Leasing Co, Inc., its designees, and any third-party to whom this Application is provided may rely, without any independent investigation or verification, on the truth of the statements contained in this Application.
